La sucesión de estados en materia de tratados territoriales y de fronteras a la luz de la jurisprudencia de la Corte Internacional de Justicia

Este artÃculo tiene como objetivo discutir los efectos y las consecuencias de la sucesión de Estados respecto de los tratados internacionales, especÃficamente, de los regÃmenes fronterizos y territoriales construidos por tales documentos. Por lo tanto, utilizando el método de enfoque deductivo, el presente estudio se divide en dos partes. En primer lugar, desde el procedimiento de análisis descriptivo y desde las técnicas de investigación bibliográfica y documental, pretendemos llevar a cabo a través de este texto un amplio estudio de las teorÃas que orientan los efectos sucesorios de los tratados en los casos de separación de Estados, esto es, la teorÃa de la continuidad y el principio de la tabula rasa. En seguida, a través del procedimiento analÃtico de análisis, buscamos verificar objetivamente los regÃmenes territoriales y fronterizos, señalando, respectivamente, a partir de un estudio de los casos Gabdikovo-Nagymaros y Lybia vs. Chad ante la Corte Internacional de Justicia, qué modulaciones se pueden hacer a los tratados de fronteras y territorios para los Estados sucesores. Al final, se concluye que, a pesar de que la teorÃa de la tabula rasa se utiliza como una excepción al principio de continuidad de la vinculación estatal, se sigue aplicando cuando se refiere a los tratados en materia de fronteras y territorios, a pesar de que su aplicación no se exentó de crÃtica.
